Let me get this straight. I get drunk, take a cab home and could be liable for my stupidly driving afterward because they dropped me near someplace I might have a car?

Would they also be liable if they dropped me someplace near a tall building I might jump off of?

Additional comments from Althouse's site - apparently not only did he kill someone by running the stop sign - he was running the stop sign in an attempt to evade police and avoid getting a 4th DUI. I have to say I'm a little disgusted at Althouse for how misleading her post is.

He clearly had no idea how to handle a gun.

Even if liability was clear, that's an outrageously high verdict - especially for a guy who is still working and getting disability.

Subject matter of this post aside, the title is grossly misleading, even if the ambiguity is removed. (I know, it's a third-party feed). Perhaps the video helped put the defendent away because he operated a vehicle in such a way that now someone is dead. Maybe the title should read, "The video that...for pressing the accelerator."

What if the employee's scent is a part of her religion? What's an employer to do now? What does a candle company do if an employee is sensitive to the smell? The world of ADA law is bad enough. Come Jan. 1, with the ADA AA, we're going to see this only get worse.

Commerce Ins. Co. v. Ultimate Livery Service, Inc.
2008 WL 4981557
November 26, 2008

As a law student studying for my Torts exam in two weeks, this is an interesting case. If the defendants are held liable, I hope there's some kind of partial indemnity that only makes them liable for the .0001% of their actual fault for the wrongful death. Which reminds me that I need to study damages...
