The fact that a case was discontinued doesn&#039;t tell us whether or not it settled.

In this particular circumstance, of course, the timing of the d/c sure is odd given the show cause order regarding the subpoena.  It makes one wonder whether  a defense will be that the case is over and the court shouldn&#039;t rule on the sanctions on that basis.
