What sort of society assumes that consumers are not able to determine what is in their best interest? Paternalist? Authoritarian? Totalitarian?

That assumes that consumers are capable of determining the ability of Bertram Brown to practice law. If a consumer is unable to make an informed choice there exists a great potential for fraud.

There is no good reason that a government-sustained cartel should be able to decide who may practice law. If consumers want to take a chance with Bertram Brown that should be up to them.
