by Walter Olson on May 5, 2009

Things are getting serious, the newest report being that “South Carolina Attorney General Henry McMaster sent a letter to craigslist CEO Jim Buckmaster threatening company management with ‘criminal investigation and prosecution’”. Earlier here, here, etc.

I’m no legal expert, but is there any reason Craigslist can’t tell South Carolina to go screw? It seems to me that a) they’re covered under existing laws which prevent such sites from liability from things their users post and b) South Carolina courts lack jurisdiction over Craigslist.

Best thing that could happen for Craigslist as it is free publicity.

No way the state could win that suit in view of esisting laws on the federal level which would most likely preempt any state challenge.
