If they were in a position to file a legitimate suit before a new deadline that caps damages, they could be committing legal malpractice if they didn’t.
I had occassion once to race to the courthouse door to beat a deadline for a new statute, which I learned about via a listserv, and wrote about it. I consider it some of my best (albeit simplest) legal work:
