Cheltenham, U.K.: “A businessman is facing a £300,000 legal bill after losing a boundary battle with his neighbour – over an area of land of just seven square yards.” About half of that represents the loser-pays bill that will be handed to Martin Charalambous and his partner for pursuing a legal campaign through appeal whose cost far exceeded the value of the land. well, its ridiculous, but the beauty part is the guy pushing the frivolous suit now is paying.

My uncle, a retired farmer, once had to fend off a suite over small area of land that a homeowner claimed as his. It took a lot of money many years ago just to defend himself.

This case illustrates the near-perfection of the “loser pays” system.

A party pursued a trivial case to the bitter end, and the “punishment” is more than just.
