SLAPPing with impunity in California

by Walter Olson on October 30, 2010

A California court rules that attorneys who file unjustified suits aimed at speech or political activity can’t be made to pay the other side’s fees. If you’re a victim of such an action, you still might get lucky and collect from the client who instigated it. [Cal Attorneys Fees]

Isn’t it about time that attorney fees were regulated as they did us in medicine? After all, I know few people who have not experienced a court action and the need for an attorney. In fact, I would say the chance of having to see an attorney is greater than that for having to see a doctor. The contigency fees that attorneys receive is more repulsive than the bonuses for big business.

I recommend a salary that starts at minimum wage for newly accredited lawyers, escalating $1.00/hr per year of practice. If that’s too low, then perhaps other lines of business would be more appealing.

John Burgess, such a low salary would not reduce the cost of legal representation. The employer of a $10/hour lawyer would simply claim that he worked 150 hours per day.
