Law imitates the Onion.
This is actually perfectly reasonable. The suit is about a rigid requirement that musicians be no more than 40 years old. The complaint about the judge is that this particular judge is incapable and is based on alleged facts about this judge. The plaintiff is not arguing that no judge over a certain age can be competent.
