You truly cannot make this stuff up.
I am sure that justice will pevail, with such an insightful, cautiously honest judge.
Actually, Smart Dude, there is a logic here. First, presumably the class members are identifiable by fax number. They may not be identifiable by any other means. So this may be the best way to provide them notice. Second, a fax about the class action over unwanted faxes is not in the same “unwelcome” category as the underlying unwanted fax itself.
By the way, I’ve practiced in Judge Cueto’s courtroom, and he’s fair and very sharp.
