From attorney Larry Bodine’s Twitter account, two hours after last night’s crash of Amtrak’s Northeast Regional outside Philadelphia that left six dead and more than 65 injured:

No question about it, this crap gives all lawyers a bad name. While done by a very small minority of people, it is often the bad stuff that people remember.
Side note: The new universal bar exam will worsen the situation unless ethics committees crack down on those who outsource their ethics to these marketing companies.
One more note. While the practice might not breach ethics rules in PA (but still be scummy) , it doesn’t appear to be ethical in NY. And many of the victims were likely headed to NY and will likely call NY attorneys. Others may contact local counsel directly.
This is a bit of Wild West stuff going on, since there aren’t an abundance of ethics opinions (in NY, where it isn’t allowed) on the subject.
