What’s to figure? Trump is an imbecile. He doesn’t know and he doesn’t care what the law says.
“Hire American” doesn’t seem to be problematic. Certainly, POTUS gets to be hortatory in an EO–and “Hire American” probably wouldn’t exclude lawful resident aliens etc.
