“The case against mandatory seat-belt laws”

The federal seat-belt-law mandate was the result of a 1980s deal between Reagan-era Transportation secretary Elizabeth Dole (proof, long before Mayor Bloomberg, that nanny-state tendencies transcend partisan labels) and Detroit automakers, who calculated that regulating their customers would help stave off regulating their own design decisions. And now? Gothamist on why the Robicelli bakery of Bay Ridge, Brooklyn, has decided to move to Baltimore, worn down by hassles with New York labor laws, utilities, rents, alternate side of the street parking enforcement, and more:

The culture of fining small businesses and attaching expensive requirements for permitting and other work can make owners feel as though they’re ATMs for the city, from what some call excessive policing of restaurants by the DOH to the installation of a hand sink that cost the couple $10,000 after acquiring and hiring the necessary permits and persons to get the work done up to city code. “If you see some guy having an ice cream cart in front of his shop? Huge permit! Outdoor seating? Huge permit! If you decide you just want to have a bench in front of your store but somebody decides to pull it out a little bit so it’s a little bit over 18-inches off the front? Fine! Massive fine!” …

“New York now is a city of no. You have this great idea? No, you can’t do it. You want to try this out? No. You go to Baltimore and it’s a city of, ‘Well why the f— not? Let’s try this!’ They really, really love their city and it’s exciting. It’s that energy I felt when I was growing up in New York.

St. Louis suburb runs town hall on ticket money. Is that illegal?

We’ve reported many times on the syndrome of towns outside St. Louis which, often lacking another promising tax base for municipal services, run ticket mills so as to get by on fine and fee revenue. Missouri law limits the share of their budget that can be derived from traffic fines, but not other fines, which means that some towns like Pagedale hammer their homeowners and other locals with regular fines over untrimmed trees, barbecue sets left in front yards, and other minor offenses. But is this illegal? An Institute for Justice lawsuit seeks class-action status on behalf of persons fined for violations as minor as mismatched blinds. [Scott Shackford, Reason]

An observation on the $135,000 cake refusal

Has anyone noted that the “Ferguson syndrome” of ruinously escalating fines for petty violations [covered widely in the liberal press, and here previously], and Oregon’s ordering of a couple to pay $135,000 for not complying with a request to bake a cake (being covered at AP, widely in the conservative press, and here previously, with related], might actually amount in part to the same issue?

P.S. On Twitter, colleague Jason Kuznicki and I discuss the issue a little further. He writes: “Can’t say I agree. Punitive fines are really hidden taxes. The bakery issue is about punishing crimethink.” I respond: “But with sensible damages calculation (i.e. circa zero) the bakery action would lose much of its power to intimidate. Also, there’s debate: are oppressive local fines ‘just’ a revenue abuse (typically our side’s view) or a wider #NewJimCrow? Or to put it yet another way: once you allow oppressive fines, don’t be surprised if they are used to oppress.”

“Taxation by citation”

Missouri lawmakers are discussing a bill that would discourage speed traps and excessive municipal reliance on fines by providing that revenue from traffic citations could not exceed 10 percent of a town’s revenues, down from 30 percent currently. [St. Louis Public Radio]

Former St. Louis County Police Chief Tim Fitch testified in favor of Senate Bill 5 Wednesday before the senate committee on local government.

“We are not supposed to be in the business, in law enforcement, of generating revenue for the cities,” Fitch said. “I think, personally, municipal courts should be able to recover their costs, but they shouldn’t be profit generators. It’s not a business; you’re not supposed to be able to buy chairs for the mayor’s office with traffic ticket fines.”

The bill’s sponsor, state Sen. Eric Schmitt (R-Glendale), cited the way traffic citations can snowball with late fees, doubling or tripling of fines, arrest after missed court dates, and loss of jobs. Many towns, on the other hand, don’t want to lose the revenue:

City officials, including a few mayors such as Cool Valley Mayor Viola Murphy, testified against the bill.

“You have money that comes in, but it goes right back out,” Murphy said. “It goes back out to different funds that are needed … I wouldn’t want to see (the) battered women’s fund cut; I wouldn’t want to see police training cut.”
