  • In the NYT article on Julian Heicklen, did the government really say that he doesn’t have the right to a jury trial (last paragraph)? Am I reading this right? Is that something that a judge can waive?

    I don’t know. For some reason the Times spends two pages discussing the prosecutor’s brief, and doesn’t actually post it. It’s so irritating when newspapers do that.
